Powers Of Attorney's
LASTING POWER OF ATTORNEY LPA
If you lose the ability to manage your affairs through accident or ill-health you would
assume that your partner of family would be able to make decision on your behalf. This
is not the case!
This is a legal document that allows a person (the Donor) to appoint people to act on their behalf
(the attorney(s) either when they are no longer capable of acting for themselves, or sooner if
required.
- An attorney can be a spouse/civil partner or informal partner or trusted family member
and friends. - Arrange things now while you are still fit and able.
- LPA’s are recommended for clients wanting to decide what happens if they lose mental capacity
from Your point of view. - You can decide who would look after you; Who deals with your finances like paying bills,
shopping, banking and property. - Make decisions about your medical care and decisions about the way you live your life.
An LPA only takes effect once registered with the Office of Public Guardian.
There are two Types of LPA’s
1. Property and Financial
A Property and Financial LPA can allow Trustees to:
- Operating bank account;
- Paying the mortgage or rent and household expenses;
- Insuring, maintaining and repairing property;
- Claiming, receiving and using benefits and pensions on the donor’s behalf;
- Giving access to financial information;
- Investing the donor’s money;
- Paying for private medical care, residential care or nursing home fees;
- Buying/Selling property;
- Paying for private medical care
2. Health and Welfare
A Health and Welfare LPA can allow a Trustee to make decisions about:
- the Donor’s permanent residence;
- who they should live with;
- assessments for and provision of community care service,
- day to day care;
- consenting to or refusing medical examinations and treatment;
- arrangements for medical, dental or optical treatment
Pricing
Fees start from £250 per LPA, rising to £500 for more detailed arrangements.
